A fine example how innocent, decent people are being treated by ATOS medical Services

Also lessons to be had about needing prior knowledge of what the medical entails and what the questions mean without which most people are failing.

The DWP's Orwellian-style work capability assessment forces people like me to work when they are not fit enough..... http://www.guardian.co.uk/commentisfree/2010/aug/27/me-benefits-work-capability-assessment

The WCA is one assessment at a particular point in time. The assessment is intended, regardless of when it is carried out, to take into account how a person’s capability may vary over time. Its intention is to assess whether a person can complete a task reliably, repeatedly and safely.

"Question 3: What is the best way to ensure that the effect of fluctuating conditions is reflected in the recommendation of the WCA?"
Taken from the consultation via the link in the Guardian article

Surely a series of assessments and not just carried out by ATOS but all relevant professional bodies would be more appropriate (like visits to GP's, psychiatrists, occupational therapists etc). This is more than feasible in view of the time available waiting for appeal tribunals whose backlog is continuing to grow. And that all the evidence be duely considered unlike at present when it all has to be available at the time of the all crucial medical report which decisions are virtually entirely based upon.

I conclude that the current ATOS/DWP WCA is not fit for purpose i.e. in adequately and accurately assessing a claimant's true physical and/or mental health with respect to how they would likely cope in a 'new' work environment. Therefore, this is bordering on professional and medical negligence.

Perhaps an alternative approach would be to get all the fully able bodied people actively seeking employment allocated into posts first and extending business grants beyond 25 year olds, whilst also in the meantime spending all the piles of unclaimed benefit money on vital care, support and research of the various illnesses ATOS appear to be in ignorance or denial of.

The government could also focus it's attention on the far more costly area of tax evation by the wealthy which dwarfs benefit fraud by comparison.

Or just carry on with the lip service, ignoring duty of care (members of parliament are supposedly elected to represent the public) and keep picking on easy targets who often are not even capable of attending a medical or tribunal let alone cope with the paperwork. As when like me at times they can actually defend themselves it goes against them anyway.

It isn't Orwellian so much as it is medieval. Now how was it they determined a witch again? And we call it a civilised society. Undecided

In short ESA is a set up, a gimmick to make the previous government look like they were tackling unemployment. A visit to your local job centre will provide a good start point to anyone wanting to assess the efficiency levels of the benefits service. I would describe mine in one word 'chaos'.

Very succinctly put considering the fact that most illness and conditions flutuate the only people who are definetely okay with ESA is the case of falling of ladder and breaking your back. Your nod to the witch hunt is also true. It seems that the most unvunerable are coming off worst. Take this story:
Quote:
I've got a lot to say and a lot of questions!

Firstly i've been involved with my cousin's claim for ESA now for months, he was forced to take early retirement from our local hospital due to COPD, he then was diagnosed with leukaemia and lost his sight. Any normal person can see he can't work. He was granted ESA, but he has to continue to go for assessments to see if he has found a miracle cure and is able to work. He has been told to apply again for the highest level of support (by his case worker) as he is eligible and in need of it but the problem is his pride. Not only wont he do this but in his last assessment he talked about going to the supermarket and then the shop and going for walks, doing his ironing, that he can take care of himself. The real situation is: he walks to the petrol station at the supermarket (50 yards away from his house, this is what he means by both supermarket and shop) has repeatedly fallen in the road and nearly got run over, he buys whatever is available at the petrol station to eat with the help of the staff who also help him back across the road. He has not done any house work in months, once he gets back home he can't function for the rest of the day and one day he will get run over because it nearly happened when i was with him, he couldn't see a bus that was right in front of him! What the hell can we do if he refuses to do what is best for him?

Now unless this person is a master of disguise and an actor of extrodinary quality why on earth is he being asked to attend a medical to see what type of work he can do?
"Oh", they said "He has told us he is capable of such and such",
They always take into account what they think are exaggerations but never seem to think some people who are proud might actually be overplaying what they can do.

Their so called bible "The disability handbook", writes about people and symptoms as if they are some mathematical concept- nothing about side the box. No room for fluctuation.

The other point you touch upon is coping in a new work environment. Upon meeting somebody once they can conclude the outcome of how they will cope.

This brings to mind the story of someone suffering from Irritable Bowel Syndrome. It was written in their report that they had waited one hour in reception before being seen at medical and during that time DID NOT ask for key to use the toilet. (Apparently by making claimants get up, go to reception and ask for key they are able to observe rising up from chair, communication with strangers, thought patterns and comment on them). He later found in his medical report that his IBS caused no problems whatsoever and he could control his bowels.

They did not know that he actually did ask for the key at reception but no one could find it, luckily he was wearing some sort of incontinence underwear but had to sit through medical and journey home before changing.

This could lead me on to a rant about lack of dignity... But that for another time.
In short I totally agree when you say WCA is not fit for purpose
