Hi all just a question about my ESA
Thayve stopped mine as Ive had it for 12 months but Im still to Ill, as I have a bad heart and wont get better, 4 weeks ago I split with my partner and moved in with my elderly parents until I sort something out with a house ect...as shes met someone alse...
Now since ive move in with my parents Ive had this letter off the DWP saying my contribtion base ESA has stopped and I will have to apply for income related ESA....
When I was with my partner she was working and it states (if your partner in doing 24 per week or you have a capital between you worth over £1600 then you may not be intitled.
But the circumstances have changed and it means my elderly parent whom are in there 70's will have to support me is that right???
Plus my mother thinks me claiming/being there will affect how much rent she will have pay / connsil tax ..at the mo they dont have to pay anything as there both pentioners...

Could anyone poss advice thanks

P.S I know I should have let them know but I though I would be geetin back with girlfriend but she met someone else.....

God I wish I could give you a hug. I also wish I could get up proper advice but I think better heads than mine are needed.

For now if I were you I would get on with your ESA Claim but PLEASE do it properly and make sure you have all the correct info before you begin. Read my claim forum guide Link in my signature. Read it carefully takes you page by page through the claim form and what to expect at medical. In the meantime I,ll ask my cronies for indepth info about living with parents etc.

Your circumstances as they are now, are what counts when you claim Income Based ESA. The fact that you used to have a working partner is not relevant, though I agree it's a very recent change for you.

I'm not sure that you count as a dependant of your parents, given you're all adults? Also, your total joint income would be low unless your parents have private pensions too. The savings figure I believe is £16,000 not £1600, but others may want to correct me on that (it's £16,000 for Housing Benefit, I think?).

I'm no expert on Income Based ESA but I think it is similar to claims for Income Support except you get a disability addition.
