There are special rules in place for vulnerable people, as shown in the diagram in the thread above.

Q. Will the DWP determine those vulnerable and or below the poverty line, but then will they be below the poverty line because then they would be entitled to IR ESA?

Also please do contact W/R or advocacy (see my signature for a list) for further advice on this matter, contact MP's.
We need to keep the MP's and welfare rights informed of the issues the Welfare Reform Act 2012 is causing.

It is new ground, we have to collectively discover the process.

The NEW Welfare Right Act 2012, now enacted, has some particular interesting sections which will need proper advice to interpret. Welfare rights reps will be updated with procedures and interpretations of these new rules and regs.

The pdf enclosed below should be interpreted in addition to the 2007 Welfare reform act, however, it seems there could be some flexibility with time limiting, and or the length of time between claims, and possible hardship claims?

The new rules regarding Claimant responsibilities/commitments need's further reading as it seems to me that the commitment could be different for each claimant depending on their circumstances?

Changes to Employment and Support Allowance
Time limiting contribution-based Employment and Support Allowance to one year for people in the Work Related Activity Group

The Welfare Reform Bill applies a one-year time-limit to contribution-based Employment Support Allowance (ESA) for those in the Work Related Activity Group. This change will be introduced in April 2012 and will have an immediate effect on people who are currently claiming contribution-based ESA as well as new claims.

People in the ESA Support Group will be unaffected by the change, as will anyone receiving income-related ESA regardless of which group they are assigned to.

After a year, those people who have no other means of supporting themselves may qualify for income-related benefits – there will always be a safety net for those who need it. Of those affected by time limiting contribution-based ESA, we estimate that 60 per cent will be able to claim some income-related ESA. Other benefits such as Housing Benefit and Disability Living Allowance may be available to those claimants affected by the introduction of a time-limit.

Here are two documents from dwp regarding CB ESA time limiting.
ESA Q And A page 8

If someone has claimed contribution-based Employment and Support Allowance for 365 days will they be able to re-qualify? Claimants may be able to re-qualify for a further 365 days of Employment and Support Allowance if they leave benefit for more than 12 weeks and they meet the National Insurance conditions in full, without using the same two tax years of their previous claim. This is the same approach used for assessing entitlement to contribution-based Jobseeker’s Allowance.


ESA Changes Page 3 and 13.

Why these changes have been introduced
10.We want to modernise the current welfare system and in advance of the introduction of Universal Credit. focus support where it is needed most and redefine the contract between the state and individuals,
11.These changes also reflect the fact that ESA (C) for people in the WRAG was never intended to be for the long term but to provide interim support for those who presently have limited capability for work and are expected to be able to move into work in the future. The Government expects people receiving ESA (C) to take up the help and support available to them so they can move off benefits and into work.

Summary of key facts
24.The legislation takes effect on 30 April 2012.
25.We expect around 100,000 people will immediately lose entitlement to ESA (C). We estimate around 60% of these will have some entitlement to ESA (IR).

Hi Ijust wanted to mention that your link above takes you to the Cooperative mobility website, and I can't find any section that gives info about rates, it is all about elling mobility aids virtually.
